Terms of service
Effective 2026-07-10 · Final legal review pending
1. Acceptable use
You agree to use SpecRecord only to record installations you performed (installers, suppliers, distributors) or properties you own or represent (homeowners, building management, insurance carriers). Fraudulent certificate attestations — submitting readings you did not take, photos you did not capture on-site, or signatures you did not obtain — are grounds for immediate account termination, forfeiture of any purchased record bundles, and referral to the NWFA and any relevant trade certification body.
2. Certificate immutability
Once a certificate is locked, it cannot be edited or deleted by you, SpecRecord, or any third party. The certificate's content hash is submitted to OpenTimestamps and anchored to a public blockchain within hours of lock. Anyone in the world can independently verify — using open-source tools, no SpecRecord involvement — that the record existed exactly as it does today at that moment. This immutability is a feature, not a defect: it is why SpecRecord is trustworthy as evidence in claims and disputes.
3. Accuracy of records
You are solely responsible for the accuracy of readings, photos, materials data, and signatures you capture. SpecRecord certifies that the data was sealed at the timestamp shown and has not been altered since. SpecRecord does not certify that the readings are correct, that the meter was properly calibrated, or that the installation itself complies with manufacturer or industry specifications — those responsibilities remain with you.
4. Privacy and access
SpecRecord contents are private to the record owner (typically the installer's tenant) and authorized property parties. QR codes and record URLs require sign-in and do not grant access by themselves. Detailed readings, addresses, photos, signatures, and PDFs are not exposed through public lookup. When an NWFA claim is filed, a credentialed inspector may request record-specific access via Off-Record. An inspector role never permits cross-customer browsing; approved access is read-only and audited.
5. Pricing and payment
NWFA-member accounts receive the first 5 SpecRecords at no charge for launch. Beyond that, users activate the Platform plan and purchase record bundles; current pricing is at /portal/billing. A valid payment method is required at sign-up. Purchased record bundles do not expire but are non-refundable once redeemed. Manufacturer and insurer API access is volume-licensed — contact sales@specrecord.com.
6. Suspension and termination
SpecRecord may suspend or terminate an account for fraud, non-payment, abuse of the platform, or credible reports of misuse. Locked certificates already anchored to a public blockchain remain independently verifiable regardless of account status — the record persists beyond the account.
7. Warranty disclaimer
SpecRecord is provided "as is." SpecRecord makes no warranty that the platform will be uninterrupted, error-free, or fit for a particular purpose beyond the sealed-record functionality described in these terms. Cryptographic guarantees are inherited from the underlying Bitcoin blockchain and OpenTimestamps protocol; SpecRecord does not warrant the operation of either.
8. Limitation of liability
SpecRecord's aggregate liability under these terms shall not exceed the greater of (a) fees paid by the account in the preceding twelve months, or (b) US $100. SpecRecord shall not be liable for indirect, incidental, or consequential damages, including lost profits, arising from use of the platform. The underlying obligations remain with the parties to a transaction — installer, customer, manufacturer, distributor, carrier.
9. Governing law and disputes
These terms are governed by the laws of the State of New York. Disputes are resolved by binding arbitration under the American Arbitration Association's Commercial Arbitration Rules, seated in New York County, NY. Nothing here waives your right to bring a small-claims action or to seek injunctive relief for intellectual-property violations in a court of competent jurisdiction.
10. Changes to these terms
SpecRecord may update these terms; material changes are posted here with a new effective date and, for account holders, sent by email. Continued use of the platform after the effective date constitutes acceptance.
